Termination

Termination of your access will result in the immediate cessation of your rights to use the Service. You may simply discontinue using the Service at any time if you wish to terminate the Agreement.
Limitation of Liability
Notwithstanding any damages that you might incur, the entire liability of the Company and its suppliers under any provision of these Terms and your exclusive remedy shall be limited to the higher of: either the amount you have actually paid for the Service, or 100 EUR if you have purchased nothing for the Service.
To the maximum extent permitted by law, neither the Company nor its suppliers shall be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, business interruption, personal injury, or loss of privacy).
"AS IS" and "AS AVAILABLE" Disclaimer
The Service is provided to you in its current state and subject to its availability without any representations. The Company disclaims all express, implied, statutory, or other warranties to the maximum extent permitted by law. This includes, in particular, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement of third-party rights.
The Company does not guarantee that the Service will meet your requirements, operate uninterrupted, securely, or error-free, or that any defects will be corrected.
Governing Law
The laws of the country Germany, excluding its conflict of law provisions, shall govern these Terms and your use of the Service. Your use of the application may also be subject to other local, state, national, or international laws.

If you are a consumer in the European Union, you benefit from all the mandatory provisions of the law of the country in which you reside.
Compliance with US Legislation
You represent and warrant that (i) you are not located in any country that is subject to a United States government embargo, or that has been designated by the United States government as a “terrorist-supporting” country, and (ii) you are not listed on any United States government list of prohibited or restricted parties.
Severability and Waiver
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be changed and interpreted to achieve the objectives of that provision to the greatest extent possible under applicable law, and the remaining provisions will remain in full force and effect.
Waiver
The failure of either party to exercise a right or to require the performance of an obligation under these Terms shall not affect that party's ability to exercise that right or require that performance at a later time. A waiver of the assertion of a breach of contract shall not constitute a waiver of the assertion of later breaches of contract.
Translation Note
These Terms and Conditions may have been translated if we have made them available to you on our Service. You agree that in case of conflict, the original German text shall prevail.
Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined in our sole discretion. By continuing to use our Service after any revisions become effective, you agree to be bound by the revised terms.
